Federal Protest Crackdowns: ICE Killing of Renee Good, Insurrection Act Threats, and Criminalization of Dissent

What Happened

The Trump administration conducted a sustained escalation of force against protesters across the United States, culminating in the fatal shooting of an American citizen by an ICE agent, the deployment of thousands of federal agents to American cities, threats to invoke a wartime statute to suppress protests, and the issuance of a presidential memorandum classifying political opposition as domestic terrorism.

The Killing of Renee Nicole Good

On January 7, 2026, ICE agent Jonathan Ross fatally shot Renee Nicole Good, a 37-year-old American mother of three, in Minneapolis. The shooting occurred during what DHS called "the largest immigration enforcement operation ever carried out," with 2,000 agents deployed to the Minneapolis-Saint Paul metropolitan area.

Good was sitting in her car, stopped sideways in the street, when agents approached. One agent reached through her open window and ordered her out. Good briefly reversed, then began moving forward and to the right. Agent Ross, standing at the front-left of the vehicle, fired three shots as the car passed him, killing her.

Federal officials and President Trump defended the shooting as self-defense, claiming Good "ran over" the agent who was "recovering in a hospital." However, the ICE officer's own cellphone video showed a peaceful encounter and did not depict violent behavior. Available video evidence showed Good did not hit or intend to hit the officer.

Good was the ninth person shot by ICE agents since September 2025. On January 24, a CBP officer fatally shot Alex Jeffrey Pretti, making two American citizens killed by federal immigration agents in a single month.

Insurrection Act Threats and Military Deployment

Following the Good shooting, Trump posted on Truth Social threatening to invoke the Insurrection Act — an 1807 law authorizing the president to deploy the military domestically — to suppress protests in Minneapolis. He characterized protesters as "insurrectionists" and demanded that state officials "obey the law." Attorney General Blanche accused the Minnesota governor of "terrorism."

Three thousand ICE agents were deployed to Minneapolis in "Operation Metro Surge." The administration also forcibly federalized National Guard troops over the objections of governors in Los Angeles, Portland, and Chicago.

NSPM-7: Branding Political Opposition as Terrorism

On September 25, 2025, Trump issued National Security Presidential Memorandum 7 (NSPM-7), "Countering Domestic Terrorism and Organized Political Violence." The memorandum:

• Designated "Antifa" as a "domestic terrorist organization"
• Directed Joint Terrorism Task Forces to investigate and prosecute people engaged in "politically motivated terrorist acts" — defined to include civil disorder, destruction of property, "organized doxing," trespass, and protest-related activities
• Branded opposition to capitalism and anti-fascism as forms of domestic terrorism
• Conflated entirely unrelated events — protests against police, opposition to ICE, the killing of a healthcare CEO, and assassination attempts — to fabricate the appearance of a coordinated left-wing terrorist movement

The Brennan Center for Justice found that NSPM-7 "aims to criminalize opposition" and threatens "any person or group holding any one of a broad array of disfavored views with investigation and prosecution."

Expanded Federal Police Powers

On November 6, 2025, the administration fast-tracked the implementation of new rules granting the Federal Protective Service sweeping powers to:

• Make arrests off federal property (not just on it)
• Ban wearing masks near federal buildings
• Criminalize loud noises that "disrupt government employees"
• Criminalize blocking entrances or exits to federal property

The rules, originally scheduled to take effect January 1, 2026, were moved up to November 2025 — providing new tools for the administration to target protesters.

International Law Concerns

Right to life (ICCPR Article 6): The shooting of Renee Nicole Good — an unarmed American citizen whose own car-mounted encounter was shown by video to be non-violent — raises serious concerns about arbitrary deprivation of life. The UN Basic Principles on the Use of Force require that firearms be used only against imminent threat of death or serious injury.

Freedom of assembly (ICCPR Article 21): The right of peaceful assembly may be subject only to restrictions "necessary in a democratic society."
